Terms of Service
These Terms of Service ("Terms") govern your use of the Spottle mobile application and the spottle.app website ("Spottle"). By installing, opening, or using Spottle, you agree to these Terms. If you do not agree, please do not use Spottle.
1. Who may use Spottle
Spottle is designed for children ages 4–13. A parent or legal guardian must accept these Terms and the EULA on behalf of any child under 13 before the child uses the app. By creating a child profile, you represent that you are the child's parent or legal guardian and that you consent to the app's collection and use of information as described in the Privacy Policy.
2. License to use the app
Spottle grants you a limited, non-exclusive, non-transferable, revocable license to download and use the app on an Apple device you own or control, for personal, non-commercial use by you and the children in your household. Your use is also subject to Apple's standard Licensed Application End User License Agreement (EULA), as supplemented by our additional terms in the Spottle EULA.
3. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract credentials or API keys from Spottle.
- Use Spottle to send to our AI partner any content that is sexual, violent, hateful, harassing, or otherwise inappropriate for a children's product.
- Use Spottle in a way that violates any law, including the COPPA or GDPR-K.
- Interfere with, overload, or probe the services that power Spottle.
- Attempt to bypass the parental gate or app-integrity checks.
We may suspend API access or take other action to protect Spottle, its users, and our service providers.
4. AI features
Spottle uses Anthropic's Claude API to describe cloud shapes in scan photos. AI output is imaginative and not a factual claim about the real world. It may occasionally be wrong, silly, or unexpected. Do not rely on Spottle's output for any decision that affects health, safety, education outcomes, or anything important. Spottle is entertainment.
5. Content ownership
You own the photos your device captures. When your child scans a cloud, the image is transmitted to our AI provider solely to generate a response, and then it is discarded as described in the Privacy Policy. Spottle and its logos, text, audio, video, artwork, and source code are owned by the Spottle team and are protected by copyright and other laws.
6. Purchases and subscriptions
If Spottle offers paid features, they are purchased through the Apple App Store and are governed by Apple's terms. All purchases require a parental gate. Refund requests must go through Apple.
7. Disclaimer
Spottle is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that AI output will be accurate.
8. Limitation of liability
To the fullest extent permitted by law, the Spottle team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of Spottle. Our total liability for all claims relating to Spottle will not exceed the amount you paid us in the 12 months before the claim, or USD $10, whichever is greater.
Some jurisdictions do not allow these limits; in those places, these terms apply only to the extent permitted by law.
9. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Effective" date and, where appropriate, show a notice inside the app the next time it opens.
10. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, except where this is prohibited by consumer-protection laws in your jurisdiction.
